INBOUND FFL STORAGE POLICY: All FFL transfers to Defenders Armory are expected to be picked up within 90 days, unless prior arrangements are made in writing via email. Any FFL transfers that have not been picked up within 90 days will become property of Defenders Armory, and may be subject to being sold to cover storage and other expenses, without compensation to the transferee. NOTE: While this policy does NOT apply to NFA transfer items during the waiting period while pending tax stamp approval by the ATF, it DOES apply to inbound NFA items if the process has NOT been started.

FFL Transfers

The transfer of a firearm from a Federal Firearms Licensee (FFL) to another FFL or a non-FFL individual (customer) is known as a Firearm Transfer. The individual or entity receiving the firearm is referred to as the Transferee.

When discussing firearms, “transfer” typically refers to the process of transferring the gun through a licensed FFL dealer to the transferee. This process was established under the Gun Control Act of 1968 (GCA), which mandates that firearms crossing state lines must be transferred through an FFL, regardless of the purchaser’s firearm or handgun permit status.

For transactions within the same state, such as gifts, loans, or sales, an FFL is not required under federal law, although state regulations may impose additional requirements.

During a firearm transfer, the FFL acquires (receives) the firearm into their records from the individual seller or another FFL (manufacturer or dealer). The FFL then transfers (disposes of) the firearm to another FFL or an individual, completing the “firearm transfer” process.

When you purchase a firearm from an FFL dealer, the firearm must be transferred to you through a legal process.

If you do not hold an FFL (i.e., you are a non-FFL buyer), you must visit the FFL dealer’s licensed premises to complete the necessary paperwork, including ATF Form 4473, and undergo a background check, typically conducted through the National Instant Criminal Background Check System (NICS).

An exception to this requirement allows for firearm transfers at “qualifying events” such as gun shows, provided the event and location are legitimate, which the dealer should confirm.

The purchase location is less critical than the transfer location. For instance, it is legal to purchase a firearm online, as long as it is shipped to an FFL dealer where you will complete the transfer process. This ensures that all legal requirements, including background checks and proper documentation, are fulfilled before the firearm is handed over to you.
